isn't responding...it is after 45? days so there is no paypal/ebay buyer protection...does anybody know what else I can do? Thanks

There is nothing you can do. It has been over 45 days. Even a regular department store would not help you after you had used it for 45 days.

eBay sales are as-is unless the seller gives a written warranty. If you have a written warranty then you follow whatever procedures it sets out, id not then you are stuck with it.

Remember, eBay "buyer protection" only applies if the iPod was not what the seller advertised it to be - if you merely didn't want it, or changed your mind, you have no protection.
